City Council Minutes 12/17/2007 Regular Meeting
PUBLIC HEARING  -December 17, 2007"text-align:left;">Mayor Danderson opened the public hearing at 7:28 p.m.  There being no one wishing to speak for or against the subject matter, Mayor Danderson closed the public hearing at approximately 7:29 p.m. 

REGULAR CITY COUNCIL MEETING - MONDAY, DECEMBER 17, 2007

Mayor Danderson called the regular City Council Meeting to order at approximately 7:29 p.m.  The pledge of allegiance to the flag preceded roll call. Present: Councilors Bigelow, Donovan, Nelson, Lafleur, Poulin, Cusson, Boucher and Grenier.  Also present: City Manager MacQueen, Mayor Elect Bertrand, Councilors elect McCue, Evans & the press.

Minutes, Previous Meetings Councilor Poulin moved with a second by Councilor Cusson to accept the minutes of the 12/03/07 WS; 12/03/07 Regular Mtg; 12/10/07 WS.  So moved, the motion carried.

Disbursements: It was recommended by the Committee on Accounts/Claims that all bills start date 12/04/07; end date 12/17/2007 for a total cash disbursement of $2,598,523.60 Draft #1556.  Councilor Nelson moved with a second by Councilor Poulin to accept the disbursement summary and pay all bills as recommended by the Committee on Accounts/Claims.  So moved, the motion carried.

PUBLIC COMMENTS:  No public comments

1. Council Committee Reports.  No Reports

2. Resolution appropriating Four Thousand, One Hundred Seventy-One Dollars and Eighty Cents to the Berlin Police Department’s Underage Drinking Grant (30-420-908-1000) budget appropriation for fiscal year 2007-08 for additional grant revenues received from the US Department of Justice for underage drinking details (30-364-602-0018).  (tabled 12/03/2007)

Resolved by the City Council of the City of Berlin as follows:

Whereas, a resolution was previously passed which authorized the Berlin Police Commission to apply for and accept grant funds from the US Department of Justice for underage drinking patrols; and

Whereas, supplemental grant funds have since become available to conduct additional underage drinking patrols during the period of November 28, 2007 to May 31, 2008.  Now therefore, be it resolved by the City Council of the City of Berlin, NH that the sum of Four Thousand, One Hundred Seventy-One Dollars and Eighty Cents ($4,171.80) is hereby appropriated to the Police Department budget for expenses related to underage drinking patrols and further the above sum is in addition to all other previously appropriated funds for the Berlin Police Department Fiscal Year 2008 Budget.  This resolution shall be in full force and effect from and after passage.

Councilor Lafleur moved with a second by Councilor Donovan to remove the resolution from the table at this time.  So moved, the motion carried.

Councilor Lafleur moved with a second by Councilor Donovan to have the resolution read a second time by title only.  So moved, the motion carried.

Councilor Lafleur moved with a second by Councilor Donovan to have the resolution read a third time by title only.  So moved, the motion carried.

Councilor Lafleur moved with a second by Councilor Donovan to pass the resolution.  Roll call resulted in unanimous affirmative votes of Council including Mayor Danderson who declared the resolution now passed.

3. Resolution authorizing the City Treasurer to sell 2,272 shares of Northway Bank stock pursuant to RSA 48:16 and depositing the proceeds in an acceptable account. (tabled 12/03/2007)

Resolved by the City Council of the City of Berlin as follows:

Whereas, the City of Berlin is in possession of 2,272 shares of Northway Bank stock; and

Whereas, the stock will be sold at market value, less broker fees; and

Whereas, proceeds from the sale of stock shall be invested in accordance with RSA 48:16.  Now therefore, be it resolved by the Mayor and Council of the City of Berlin that they hereby authorize the sale of 2,272 shares of Northway Bank stock at market value less broker fees and that they hereby authorize the investment of these funds in accordance with RSA 48:16.  This resolution shall be in full force and effect from and after passage.

Councilor Donovan moved with a second by Councilor Nelson to remove the resolution from the table at this time.  So moved, the motion carried.

Councilor Donovan moved with a second by Councilor Grenier to amend the resolution by deleting the words “approximately $20.00 per share” in the second paragraph and replace it with “at current market price” and in the last paragraph, second line, to delete “approximately Forty-Five Thousand, Four Hundred Forty Dollars” and replace it with “at current market price”.  So moved, the motion carried.

Councilor Donovan moved with a second by Councilor Grenier to have the resolution, as amended,  read a second time by title only.  So moved, the motion carried.

Councilor Donovan moved with a second by Councilor Nelson to have the resolution, as amended, read a third time by title only.  So moved, the motion carried.

Councilor Donovan moved with a second by Councilor Nelson to pass the resolution, as amended.  Roll call resulted in unanimous affirmative votes of Council including Mayor Danderson who declared the resolution, as amended, now passed.  

4. Investment Policy Adopted for the City of Berlin
Councilor Grenier moved with a second by Councilor Donovan to accept the Investment Policy for the City of Berlin as presented last week.  So moved, the motion carried.

5. Mayor's Report.  Appointments
- Zoning Board of Adjustment: Harold Bigelow as a regular member.  Councilor Grenier moved with a second by Councilor Donovan to accept the Mayor’s nomination of Harold Bigelow for a term to begin January 21, 2008 which will expire 4/2010.  So moved, the motion carried.

- Housing Authority: “Chuck” Dodge term to expire 12/2012.  Councilor Grenier moved with a second by Councilor Donovan to accept the Mayor’s nomination of Chuck Dodge.  So moved, the motion carried.

- Proclamation: Arbor Day.

Councilor Grenier moved with a second by Councilor Lafleur to accept/file the Mayor’s Report.  So moved, the motion carried.

6. Ordinance amending section 1701. Junk Motor Vehicles of the Zoning Ordinance of the City of Berlin, NH.  (1st read)

Councilor Lafleur moved with a second by Councilor Nelson to table the ordinance and schedule a public hearing on January 7, 2008.  So moved, the motion carried.

7. Councilor Nelson moved with a second by Councilor Donovan to table the resolution and schedule a public hearing on January 7, 2008.  So moved, the motion carried.

8 Polling Hours
City Clerk Debra Patrick asked Council to set, by motion, the polling hours for the January 8, 2008 Presidential Primary Election.

Councilor Grenier moved with a second by Councilor Lafleur to set the January 8, 2008 Presidential Primary Election hours from 8:00 a.m. – 7:00 p.m.  So moved, the motion carried.

9. Other.  Nothing in other.

10. City Manager's Report.
-Route 110 Phase II. The 4Eroute the City strongly endorsed may be given serious consideration.
- Main Street Demolition Bids.  John Gleason of Milan, the low bidder was awarded the contract.
- Public Works.  There is $8,000 in the budget for hired trucks for snow removal.  The schedule for tree removal is 1/11/08 Wards 1&4 and 1/18/08 Wards 2&3.
- Automatic Property Tax and Sewer Payments.  This info will be on the city website.
-Property Tax Collections.  Blandine Shallow reports that currently, 69.94% has been collected.
- Meeting with 3-D Logging.  Regarding noise complaints from Napert Village. The work should be completed in January.
- Civil Union Legislation.  The LGC provided information regarding civil unions with regard to insurance coverage.
- Leadership NH.  Coos County Administrator Sue Collins, Gorham Town Manager Bill Jackson, Representative Fred King and the Berlin City Manager made presentations to the group who represent future leadership in Coos County. 

Councilor Lafleur moved with a second by Councilor Poulin to accept the City Manager's report and place it on file.  So moved, the motion carried.

11 Public Comments:  No public comments

12. Council Comments:
-Councilor Lafleur publicly thanked the teachers for their cooperation with the new parking regulations which present safer situations for all.  He also thanked the administration and John Donaldson for the success of the new parking plan.

- Councilor Cusson inquired when the Green Street underpass will be open.  The City Manager replied that although they are still pouring concrete the plan is to open it in January.

13 Adjournment: There being no further business to come before the Council at this time, Councilor Poulin moved with a second by Councilor Nelson to adjourn the Regular City Council Meeting.  So moved, the regular meeting adjourned at approximately 7:56 p.m.
